Hello,

Where do I request a refund for my purchase of World of Kelflings?

While I do enjoy the game, the known bugs are preventing me from completing it and I do not intend to waste another 5+ hours of my time to restart it and (possibly) avoid them. I was sold an incomplete product.

Please let me know where to direct my inquiry.

I've completed the game twice now... and I believe Microsoft states that there are no refunds for games purchased via Marketplace.

I am not asking microsoft for a refund, I am asking ninjabee for one for releasing an unfinished / not adequately tested product.

If I buy any product from a store, bring it home and its broken, I bring it back for a refund or an exchange for a working one.

In this case it its not possible to exchange it for a working one and general customer service dictates that I bought something that was broken and am entitled for a refund. It is not that I don't like the game, quite the contrary, I spent my hard earned money to try this sequel however I feel ripped off right now.

Calatia,

Again I understand that XBLA sales are final, which I why I am posting directly to ninjabee who has sold a broken game to users (and hence stolen their money) to reimburse them or provide a viable fix (not being replay the entire game or load a save that does not exist)

I understand Microsoft's stance, we wont give a refund if you bought a game and don't like it, but I expect a refund for a BROKEN game.

If there is not an imminent fix, I expect a refund.

The game is NOT completely playable and the "workarounds" include replaying the game (after I have put 6 hours into it) or loading another save (which doesn't exist)

Let me try an analogy I think middle america should relate to: You buy a car (lets say a kia for you) from a dealership (microsoft). The dealership is not responsible for the reliability for the car but sells it to you and does not accept a return if 5 months down the line the transmission fails.

At this point the car vendor (i.e. the game maker) will typically issue whats called a "recall" if every transmission on their car is broken, and fix that issue without cost to the end buyer.

Well we have this exact situation, the transmission (game) is broken however the car vendor (ninjabee) cannot reasonably fix (or even offer a time for a fix) of the "transmission".

It makes me sad that people just accept getting screwed these days, even if its just $10 bucks, its $10 bucks I could have spent on something else.

This is completely laughable. Your analogy isn't even relevant to the situation you're trying to imply. In order to compare what you're trying to pull, you'd be trying to get a full refund on your car from the manufacturer for having a transmission that blew within 5 months. Even then, you wouldn't get a full refund from the manufacturer without your car having considerable other issues which were hazardous... see "lemon clause".

Since the game became available 2 weeks ago... you'll only get laughed at if you try to persue getting a full refund. The game is playable. Just because you have your own set of standards, means nothing in a court. Even they'd ask you if you tried to restart a game... or if you were smart, find someone else that may have played near the point you got to, and have them leave their game so you could save their game... and continue on from that point.

This couldn't even fall under a "lemon clause" situation because any bugs they've been made aware of, they've already stated in this forum that they have intentions of working on them... and they still have plenty of time to provide a patch for these bugs before you could even try taking this to court under a "lemon clause". For all we know, this could be an issue with your model of Xbox 360 or just specifically your xbox itself. Profiles for games get corrupted all the time, and if that's the case... that would be an issue for you to deal with Microsoft.

There are many games released with glitches. For example Modern Warfare 2 was realesed with many faults (the models, the javelin glitch, the carepackage glitch.) these were all patch via an update. I'm sure if you beleive there are faults in AWoK and it isn't just you doing something wrong then there will be an update to fix it.

Speaking for myself I have tried long ago to get a refund on an XBLA Game because it was buggy ... Nothing but dead ends ... Due to the consent and agreement you are purchasing the product as is from Microsoft on behalf of ninja bee in a short version which you agreed to when purchasing the product since you can't return digital media to the owner as you are the owner, you can't return the achievements that you did gain while you played with it as well ...

Have you actually hit the problem that blocks the last building, or are you anticipating it? If you haven't hit it, you can easily avoid it - make sure you do the witch's quests before other quests - specifically, make sure you unlock Scoobs before building the Metal Trader.

We will be fixing this problem - and the current plan is to fix it very soon.

There are other problems in the game, but as I understand it none of them prevent completion.

I'm sorry for your frustration with the game. It makes me sad that these problems are popping up. We're working hard to resolve them as fast as we can.

I also appreciate your intelligent and calm communication, in place of the inarticulate ranting I see from time to time in forums these days. :)

Thanks for responding and understanding my frustration. I am at the point where I am instructed to build the "final" building but am missing ONE more piece - the gift that will allow me to do so (I have completed the final castle).

Well I'll put this one on the shelf for a couple months and look for a time when I can d/l a fix and complete that last step. I hope its resolved and I can buy from ninjabee again.

You're probably missing the blue gift, right? That should be fixed with this interim update, with instructions here:

I'd like to know if that works as expected for you.
